INFINITY-Coach App Terms of Use and Subscription Terms

About these terms

These terms apply to your use of the INFINITY-Coach app at app.infinitycoach.com.au, operated by The Trustee for KDP Pete Trust, trading as KDP Fitness (ABN 62 343 162 414), Ravenhall, Victoria ("we", "us"). By creating an account, you agree to these terms and our App Privacy Policy.

Your consumer rights

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other laws that cannot be excluded.

Who can use the app

You must be 18 or older. Give us accurate information, keep your login details private, and use your account only for yourself.

What the app is, and what it isn't

INFINITY-Coach provides general nutrition, training and mindset coaching and education. Danny Pete is a Certified Sports Nutritionist (Sports Nutrition Association). He is not a medical practitioner or an accredited practising dietitian, and the app does not diagnose, treat or manage medical conditions.

Speak with your doctor before changing your diet or training if you have a medical condition (including diabetes, heart, kidney or liver conditions, or a history of disordered eating), are pregnant or breastfeeding, or take medication. Calorie, macro and maintenance figures are estimates. Results vary from person to person and are not guaranteed.

AI features

Parts of the app use artificial intelligence, including the AI coach, meal recognition, voice notes and meal plans. AI results can be wrong or incomplete, so check portions, ingredients and allergens yourself. The AI coach is not a medical service and is not for emergencies. If you feel unwell, contact your doctor, or call 000 in an emergency.

Free trial

New accounts start with a 7-day free trial. You don't need a card to start it. When the trial ends, you need a paid plan to keep using the app's paid features.

Plans and prices

• Monthly: $19 per month, renews automatically every month.
• Annual: $129 per year, renews automatically every year.
• 12-Week Shred Pass: $129 once for 12 weeks of access. It does not renew.
• Add-ons: Weekly Report $7.99 each, Consult Call $50 each, Meal Plan Creator $5 per month (included with the 12-Week Shred Pass).

Prices are in Australian dollars and include GST. The price, any trial period and renewal details shown at checkout apply to your purchase. Payments are processed securely by Stripe.

Trial periods on paid plans

Monthly and Annual plans may include a 7-day trial period, shown at checkout. You enter your card at checkout, but you won't be charged until the trial ends. Cancel before the trial ends and you won't be charged.

Automatic renewal and cancelling

Monthly and Annual plans renew automatically at the end of each period, and we charge your card on file, until you cancel. You can cancel at any time in the app's billing settings, or by emailing danny@kdpfitness.com.au. Your plan stays active until the end of the period you've paid for, then stops renewing.

Price changes

If we change the price of a subscription, we will tell you at least 30 days before the new price applies to your next renewal. You can cancel before then if you don't want to continue.

Refunds

We don't give refunds for a change of mind or for unused parts of a billing period, except where the Australian Consumer Law requires it. If there is a major problem with our service, you are entitled to a remedy under the Australian Consumer Law. Contact us and we will work with you to fix it.

Failed payments

If a payment fails, we will let you know. If it isn't resolved, we may pause your access to paid features until it is.

Your content

You own the content you add, such as meal logs, photos, scans and messages. You allow us to store and process it, including through our service providers and AI providers, so we can provide the app and your coaching. We will not use your photos, scans or results in marketing without your separate written permission. Only upload content you have the right to share.

Community rules

Be respectful in group chat and messages. Don't post content that is abusive, harassing, hateful, sexually explicit or illegal, spam, or other people's private information. We may remove content that breaks these rules.

Suspending or closing your account

You can stop using the app at any time and ask us to delete your account. We may suspend or close an account that breaks these terms, misuses the app or is not paid for. If we close your account for reasons other than a breach of these terms, we will refund any prepaid amount for the unused period.

Changes to the app and these terms

We keep improving the app and may change its features. If we make a change that significantly reduces what you've paid for, we will tell you and you can cancel. We may update these terms and will tell you before an important change takes effect.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss arising from your use of the app. Where the Australian Consumer Law allows us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again. Nothing in these terms limits your rights under the Australian Consumer Law.

Governing law

These terms are governed by the laws of Victoria, Australia.
